1. Eligibility

2. The Service

ShapePal provides fitness and workout tracking tools, including logging workouts, tracking progress, and related features. We may update, change, or discontinue features at any time.

3. Not medical advice

ShapePal is a fitness tracking tool only. It does not provide medical advice, diagnosis, or treatment. Always consult a qualified health professional before starting or changing an exercise program, especially if you have any medical condition, injury, or concerns. You use the Service and any workout information at your own risk.

4. Accounts

You may need an account to use certain features (including Sign in with Apple). You are responsible for maintaining the confidentiality of your account and for activity under it. Provide accurate information and notify us promptly of any unauthorized use.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service
• Interfere with other users' enjoyment of the Service
• Misrepresent your identity or affiliation

6. Intellectual property

The Service, including its design, branding, and content we provide, is owned by ShapePal or its licensors. You retain ownership of content you create (such as workout logs). You grant us a limited license to host and process that content only as needed to operate the Service.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHAPEPAL AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

9. Indemnity

You agree to indemnify and hold harmless ShapePal from claims arising out of your use of the Service or violation of these Terms, except to the extent caused by our willful misconduct.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive will survive termination.

11. Privacy

Our collection and use of personal information is described in our Privacy Policy.

12. Changes

We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance of the updated Terms.
